Walther <br />Execmive Director <br />Michael B. Long <br />Division D~reaor <br />1. The TR submittal references the original permit boundary. It is assumed this is in reference <br />to the 260 acre property boundary because the 26 acre affected land boundary coincides with the <br />permit boundary. <br />2. The TR submittal states that a portion of the access road needs to be re-routed in order to <br />eliminate the "need to cross land which is not within the permit area." The access road is part of <br />the permit area so please explain why Colorado Lien thinks the road needs to be re-routed. <br />3. If the existing access road is abandoned at the request of the landowner, and Colorado Lien <br />constructs a new road segment, and the acreage is identical, there will no need to increase the <br />affected land acreage (it would remain at 26.0 acres). However, in order for such a land swap to <br />take place Colorado Lien must begin by submitting adequate evidence (a letter from the <br />landowner) that the road will not be reclaimed but, rather, will remain as-is for the beneficial use <br />of the landowner (eg. to feed and water his animals etc.). If the landowner requires reclamation of <br />the road, the permit and affected land azea will need to be increased in order to accomoda[e the <br />new road; which may require an amendment submittal. Regazdless, Colorado Lien will be <br />required to request a release of the north access road segment in order to remove it from the <br />permit area. In order to approve a release request, the Division must be satisfied that the <br />reclamation complies with the approved permit or that the non-reclamation complies with the <br />wishes of the landowner. <br />4. The affected land area (except for the north segment of the access road) is located on Forest <br />Service managed lands (unpatented claims). Colorado Lien must submit proof to [he Division <br />that the U.S. Forest Service has been notified of the proposed access road modification submittal <br />that has been submitted to the DMG since the new road segment will be located on USFS land. <br />~ iu iiiiiiiiiiiii iii <br />STATE OF COLORADO <br />
