C-81-012. <br />Pond 006 <br />The pond without the spillways installed is capable of totally containing a <br />100 year rainfall event on the 0.7 acres of runoff area and the total volume <br />of the thickener with approximately 1 foot of freeboard. The spillways are <br />not needed and not approvable as the prep plant must be zero discharge. The <br />proposal to utilize Pond 006 as a polishing pond is also not approvable. The <br />pond is not large enough to serve as containment for both systems. As both <br />uses are projected to be emergency situations, adequate prevention of <br />discharge would not be provided. <br />To restate, a discharging structure can <br />prep plant system. As a precaution, a <br />pond will be cleaned to total capacity <br />discharge to assure that one volume of <br />Windmills <br />not be approved associated with the <br />stipulation could be added that the <br />within so many days of thickener <br />the thickener can always be contained. <br />The narrative provided draws the conclusion that no impact should occur to the <br />windmills, or springs and seeps due to longwalling in Apache and Ciruela <br />Canyons. This is based on lack of impact of development mining. More <br />subsidence would be expected from longwalling, so wells developed in upper <br />seams could be impacted. The Division's concern is that sources of water <br />remain available for livestock and wildlife watering in these canyons. <br />A statement by Wyoming Fuel committing to redrilling of the three working <br />wells on their permit boundary if their production ceases will be sufficient <br />to alleviate the concern.
