SHELTO N, Director
DATE: November 17, 1986
T0: Jeff Deckler
FROM: Candy Thompson / ~ ~ CT
RE: NEW ELK MID-TERM, TECHNICAL REVISIONS 07 AND 10, STIPULATION 14,
FINE N0. C-81-012.
Pond 006
The pond without the spillways installed is capable of totally containing a
100 year rainfall event on the 0.7 acres of runoff area and the total volume
of the thickener with approximately 1 foot of freeboard. The spillways are
not needed and not approvable as the prep plant must be zero discharge. The
proposal to utilize Pond 006 as a polishing pond is also not approvable. The
pond is not large enough to serve as containment for both systems. As both
uses are projected to be emergency situations, adequate prevention of
discharge would not be provided.
To restate, a discharging structure can
prep plant system. As a precaution, a
pond will be cleaned to total capacity
discharge to assure that one volume of
Windmills
not be approved associated with the
stipulation could be added that the
within so many days of thickener
the thickener can always be contained.
The narrative provided draws the conclusion that no impact should occur to the
windmills, or springs and seeps due to longwalling in Apache and Ciruela
Canyons. This is based on lack of impact of development mining. More
subsidence would be expected from longwalling, so wells developed in upper
seams could be impacted. The Division's concern is that sources of water
remain available for livestock and wildlife watering in these canyons.
A statement by Wyoming Fuel committing to redrilling of the three working
wells on their permit boundary if their production ceases will be sufficient
to alleviate the concern. The statement should also commit to field
verification of the well's functioning; to be performed twice yearly during
spring and mid-summer or early fall.
/vj r
5367E
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
