Lonl; <br />Dirmm~ D~reUOr <br />RE: Additions and deletions of acreage where no disturbance has occurred -Revision to <br />the policy adopted May 31, 1996 <br />This Policy may be applied where an operator wants to add new acreage by deleting undisturbed acreage <br />from the permitted area. <br />Procedure: <br />. The following conditions must exist: <br />> The area to be deleted from the permitted area must not have been disturbed by the <br />existing mining operation or any previous operator where a succession of operators has <br />occurred. <br />> The existing reclamation plan, post mining land use, and financial warranty amount are <br />appropriate and adequate for the azea to be added. <br />> L` an exchange were to occur, the total new acreage must not exceed the amount deleted or <br />released. <br />The following process shall be followed: <br />> The operator shall submit a standard request for a reclamation liability release. The <br />release of the area to be deleted from the current permit area needs to occur prior to <br />amendment approval. <br />> The operator shall submit a completed amendment application form that includes a new <br />exhibit A, a new wildlife statement from the Division of Wildlife (if the area is greater than <br />]0 acres), a revised Exhibit G or N (Source of Legal Right to Enter) and revised mining and <br />reclamation plan maps, as appropriate. The normal amendment application fee will not be <br />required. However, the operator must submit the standard fee required for a technical <br />revision. The operator shall notice according to the standard notice requirements for a <br />permit amendment. If the Division receives an objection to the application, the operator <br />shall provide the remainder of the standard fee for a permit amendment within 15 calendar <br />days of the objection. If the required standard fee is not received by the specified date, the <br />Division may deny the application. <br />This policy is not applicable and can not be used as a method to correct an existing or potential <br />violation. <br />C:\policy~cre<ch w <br />
