EX H 1 D1 I I-` ~-,~nevs o-~record of Affected <br />. land and substance'fo be reined <br />CONTRACT OF PURCHASE AND SALE <br />THIS AGREEMENT made this ~~ ~ ay of ~, 1909, beC~:n~en <br />GRACE 0'-ANNON, SELLER, and MATHIAS CODICRETP•., INC., PURC}LASER, <br />W ITNESSET}] : <br />That if the Purchaser shall make the payments and perform <br />the covenants herein mentioned, Seller will convey to it the <br />following described real estate situate in the County of Rio Grande <br />and State of Colorado, to-wit: <br />The SW; of NE; of Section 27, Township 40 North, Range 4 <br />East, NMPM. <br />Together with the following wells and well rights: <br />1. Unadjudicated well permit no. 032001-F for 200 gpm <br />issued July 13, 1987, Mathias Concrete, Inc. <br />2. Unadjudicated well permit no. 53806 for 15 gpm, <br />issued in the name of Douglas O'Bannon, located on the SW; <br />NE; Sec. 27, R. 4 E., N.M.P.M., Rio Grande County, Colorado <br />Together with all rights of way and easements, specifically <br />including a 30 ft. right of way from the northeast corner of <br />the tract sold herein extending easterly to the county road <br />known as Granger Lane. The parties understand that in order <br />to provide the easement described above, it will be <br />necessary for the Seller to make an agreement with two <br />adjoining landowners to exchange another easement through <br />the subject land for the described easement, for which <br />Seller does not presently have a conveyance. If this cannot <br />be done, the parties agree to resume use of the deeded <br />easement lying a few hundred feet South of the North line of <br />the SE'.NE; of Section 27, Township and Range aforesaid. <br />subject to easements as now located on said premises; inclusion in <br />various districts; and mineral reservations of record, if any. <br />in fee simple, by good and sufficient warranty deed, free and clear <br />of all liens and encumbrances. <br />24 <br />
