Lnng
Division Director
I am in receipt of your request for extension of abatement deadline for NOV No. CV-97-009. I
have requested that Michael Long, Director of DMG, approve an extension of the abatement
deadline, due to the following reasons.
Mountain Coal Company is in the process of monitoring the slide mass which resulted in the
issuance of the NOV to determine the nature and extent of the instability. In addition, vazious
options for ultimate repair and rehabilitation of the area subject to the instability aze being
evaluated by MCC and it's consultants. This work has progressed slowly and deliberately. As a
result MCC is not yet prepazed to implement final operational or reclamation plans. Therefore,
additional time for abatement is necessary.
I propose that a 90 day extension, beyond the initial NOV abatement date, be granted. This
would set a new abatement date of December 22, 1997 for both of the abatement steps.
Please feel free to call if you have any questions.
Sincerely,
Susan McCannon
Coal Program Supervisor
attachment: Extension of time for abatement notice
cc: Michael Boulay
David Berry
