The culvert east of the shop was operating and only the <br />trash rack required by the CMLRD and OSM was partially <br />plugged. <br />2. The portal bench drain is, in fact, working. Unavoidable <br />settling and heavy equipment usage caused the minor <br />drainage problem on the portal bench. The area will be <br />regraded as soon as conditions permit. Only a small area <br />along the outside of the portal bench was draining <br />improperly. Only a small amount of water drained over the <br />outslope and drained to the access road drainage ditch and <br />on into MB-2. No environmental damage from the runoff <br />occurred and all water was contained within the Mt. <br />Gunnison Hydrologic Protection System. <br />3. Since there is no topsoil on the portal bench cut slope na <br />damage to the topsoil resource occurred. <br />4. The debris seen on the outslope was deposited during snow <br />removal operations and will be cleaned up by the summer <br />crew as soon as weather permits. <br />Hopefully this information will assist you in determining that an <br />NOV was not warranted as a result of this combination of events. <br />Sincerely, <br />Robert D.
