Cattany <br />RE: Bowie No. 2 Mine, Permit No. C-1996-083, Bowie Resources LLC Division DIreC[O! <br />Natural Resource Trustee <br />Permit Revision No. 9, Revise B-Seam Mine Plan, Adequacy Review <br />Dear Mr. Bear: <br />The Colorado Division of Minerals and Geology (Division) has two additional questions/comments for its <br />adequacy review of Permit Revision No. 9 (PR-9), submitted by Bowie Resources LLC's (BRL) for the <br />Bowie No. 2 Mine. <br />Rule 2.03 <br />10. The Division has conducted an Applicant Violator System (AVS) check of the Bowie No. 2 Mine <br />permit. According to the AVS records, there are several West Virginia mine permits linked to the <br />Bowie No. 2 Mine permit that have pre-petition bankruptcy Federal audit violations. Therefore, a <br />stipulation will need to be attached to any proposed decision to approve PR-9. The stipulation will <br />read: <br />Approval of Permit Revision No. 9 is conditioned upon the resolution of the prepetition <br />banknrptcy Federal audit violations on the West Virginia permits linked to the Bowie No. 2 Mine <br />permit. Proof ofresolutdon should be sent to the Division as soon as it becomes available. <br />1 1.
