Long <br />Division DirKlar <br />RE: Notice of Violation CV-97-013, Bowie No. 2 Mine, Permit No. C-96-083, Bowie <br />Resources Limited. <br />Dear Mr. Bear: <br />As I had informed you in our telephone conversation of August 11, 1997, the Division is <br />issuing Notice of Violation (NOV) CV-97-013, for failure to provide proper notification <br />of blasting and for failure to keep proper blasting records. This NOV was the result of a <br />citizen's complaint inspection and subsequent review of blasting information. The details <br />of the citizen's complaint inspection were sent to Bowie No. 2 in a letter dated July 31, <br />1997. The blasting information had been requested in a letter from this Division to Bowie <br />No. 2, in a letter dated July 23, 1997. The blasting information was received at the <br />Division on August 1, 1997 and August 8, 1997. The NOV is enclosed with this letter. <br />NOV CV-97-013 cites four Regulations which were violated. The first cited regulation is <br />4.08.3(1)(a). This rule requires that the blasting schedule public notice must be published <br />at least 10 days, but no more than 20 days, before the commencement of any blasting <br />program that uses at least 5 pounds of explosives. However, the blasting schedule public <br />notice tivas published on May 7, 1997, while the first blast, which used 900 pounds of <br />explosives, occurred on May 13, 1997, which is less than the 10 day minimum time <br />period. Because there is no possibility of reinitiating the blasting notification publication, <br />this part of the Notice of Violation has no abatement step. <br />The second cited regulation is 4.08.3(1)(6), which requires that copies of the blasting <br />
