Long <br />Division Director <br />The Division has completed review of the above mentioned AHR for the <br />Cyprus Orchard Valley Mine (COVCC). Based upon this review, I would recommend <br />the COVCC be issued a notice of violation for failure to conduct hydrologic <br />monitoring as required by the approved permit. The following information <br />supports this recommendation: <br />COVCC began monitoring in June of 1992 at most sites. Although COVCC has <br />Division approval to not monitor during the winter months, they are also <br />expected to attempt to visit sites as soon as ground conditions allow a <br />reasonable person to access the site. The record shows that the spring <br />of 1992 was early and most sites would have been accessible in April, <br />with the balance accessible in May, with very few possibly not accessible <br />until June. Sites need to be visited as early as possible in the spring <br />to observe and monitor runoff flows to check for winter damage to flumes <br />and structures, and to evaluate structures for proper function during <br />flow events. <br />The following is information for each site concerning missing visits or sample <br />parameters. It should be noted that the September visit appears to be <br />universally missed for all sites and samples, when taken, always missed <br />evaluation for Chloride and Sulfate. <br />Ponds <br />Ponds are required to be visited monthly (except winter) and field readings <br />and a quarterly sample taken if the pond discharging. The earliest recorded <br />visit to any pond was June 26, 1992. Many ponds were not visited until the <br />end of July, and two ponds (19-1 and 82) were visited once in August. At <br />best, if one considers 6 months of pond accessibility, this is only a 50 <br />percent success in meeting the hydrologic monitoring plan requirements. <br />
