The Division has completed review of the above mentioned AHR for the
Cyprus Orchard Valley Mine (COVCC). Based upon this review, I would recommend
the COVCC be issued a notice of violation for failure to conduct hydrologic
monitoring as required by the approved permit. The following information
supports this recommendation:
COVCC began monitoring in June of 1992 at most sites. Although COVCC has
Division approval to not monitor during the winter months, they are also
expected to attempt to visit sites as soon as ground conditions allow a
reasonable person to access the site. The record shows that the spring
of 1992 was early and most sites would have been accessible in April,
with the balance accessible in May, with very few possibly not accessible
until June. Sites need to be visited as early as possible in the spring
to observe and monitor runoff flows to check for winter damage to flumes
and structures, and to evaluate structures for proper function during
flow events.
The following is information for each site concerning missing visits or sample
parameters. It should be noted that the September visit appears to be
universally missed for all sites and samples, when taken, always missed
evaluation for Chloride and Sulfate.
Ponds
Ponds are required to be visited monthly (except winter) and field readings
and a quarterly sample taken if the pond discharging. The earliest recorded
visit to any pond was June 26, 1992. Many ponds were not visited until the
end of July, and two ponds (19-1 and 82) were visited once in August. At
best, if one considers 6 months of pond accessibility, this is only a 50
percent success in meeting the hydrologic monitoring plan requirements.
