BRTTL~ MTN. GULll SL (ly-b(l-SSbS HUb~ "y3 11G~5y No.U11 F'.U1
~•
BMRI finds the progress and direction of the third party
sampler unacceptable. RCG has represented themsely s as a
contractor desiring and capable of performing the third
party independent sampling within a monetary budget ,and a
specified time frame. RCG has failed in this effort, not
once, but twice. This situation cannot be allowed to
continue.
BMRI believes, though well-intended, the third part
sampling effort has not been substantiative in its ~indings.
No new issues have been identified through the third party
sampling program. This fact coupled with the contractual
breach of obligations by RCG suggests this program l~e
discontinued or at a minimum modified. BMRI believ s there
exists a viable compromise position for resolution o!f the
third party sampling.
BMRI proposes that the next third party site visit kie
postponed until all outstanding site visit reports ave been
finalized by RCG (trip reports three and four). It should
be noted that BMRI has already submitted analysis r orts to
the Division for these sampling events. BMRI shoulc~bc
given the opportunity to respond to any issues of s stance
included in the site visit reports prior to release. Then,
during the fourth time period, a final sampling visit will
take place. As per the contract and MOU, the third party
sampling program will be evaluated in October.
The resolution position maintains the intent and pu ose of
the third party sampling efforts to verify on-site sampling
procedures and report laboratory results. A calerid~r year
period (October 1992 through October 1993) of sampling will
have occurred to verify data generated by BMRI and he
outside laboratory. The resolution will allow for through
review of procedures and results and will provide four any
potential concerns to be nddressed. The third part
contract will be concluded in October 1993 and cost will be
maintained within the revised budget. BMRI awaits he
Divisions response to this matter.
Sincerely,
~1~1«~:..~ Su'tr
Alana L.
