,' -2- <br />CEASE AND DESIST ORDER <br />Based upon the foregoing Findings of Fact and Notice of Violation, and <br />pursuant to the provisions of C.R.S. 34-32-124, the Board hereby orders you to: <br />1. Immediately cease and desist all mining operations located outside <br />of the present disturbance. <br />_ 2. Mail, within one (1) day after receipt of this Notice, to the Mined <br />Land Reclamation Board, written notice of your compliance with paragraph one <br />(1) of this Cease and Desist Order. <br />3. Perform the corrective actions as described below: <br />A. Perform all necessary actions to complete a Technical Revision to <br />Permit No. M-77-132 prior to the October 23-24, 1986, Board meeting, in <br />order that the Revision be approved by the Board at that meeting. The <br />Revision should include a description of all disturbances to date, <br />updated reclamation costs, and a revised reclamation plan in accordance <br />with Rule 6 of the Mineral Rules and Regulations. <br />In clarification of the rights of recipients of Notices of Violation, <br />Cease and Desist Orders, parties are advised to consult the Colorado Mined <br />Land Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain <br />acts to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order <br />are advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this z9" day of ?.(~ ,~. <br />MINED LAND RECLAMATION BOARD <br />Department of Natural Resources <br />By ~ C .~~ <br />rector <br />Colorado Division of <br />Mined Land.Reclamation <br />DCS/bdc <br />Doc.
