Date (if no date stamp): ~ ~ o b( <br />Specialist: Q~'5~,.1 <br />In connection with our discussion last week, 1 committed to provide you with <br />information demonstrating that Suburban Sand & Gravel, also known as Campbell's C- <br />Ment Contracting, Inc., is not responsible for the installation or construction of a slurry <br />wall around a portion of the perimeter of the Roadrunners Rest II gravel pit and other <br />adjacent areas. While Suburban is continuing to mine sand and gravel on the property <br />pursuant to, and in compliance with, its mining permit, it has had no involvement <br />whatsoever with the slurry wall construction activity. <br />Denver Water acknowledges that Suburban is not Denver Water's contractor for <br />construction of the slurry wall and Suburban has not been involved in the slurry wall <br />activities. Written documentation of this acknowledgement will be provided. Enclosed <br />is a copy of the Purchase and Sale Agreement among Denver Water, South Adams <br />County Water and Sanitation District, and Campbell's C-Ment Contracting, Inc. It was <br />this agreement, executed in 1999, through which Denver Water acquired ownership of <br />the Roadrunners property, with Campbell's/Suburban retaining the mineral rights and <br />the right to continue to mine sand and gravel on the property through 2006.
