Mount <br />NATURE OF VIOLATION <br />1 <br />The operator informed the Division on May 15, 2001 that mine disturbance probably had occurred to the west of <br />the northernmost pit area to the north of the gas line. The mine operator mined up to the fence line. <br />Unfortunately, the permit area was up to 30 feet east of [he fence line. <br />SERIOUSNESS <br />Administrative, describe - <br />Onsite damage, describe - <br />Offsite damage, describe -Material was excavated to the total usual depth of excavation or about 50 feet. <br />Health or safety hazard, describe - <br />STATUTE VIOLATED AND DESCRIPTION <br />The disturbance of approximately 0.2 acres of land outside the present permit boundary to the west is a possible <br />violation of CRS 34-32.5-116(4)(1) for failure to protect areas outside of the affected land from slides or damage <br />occurring during the mining operation and reclamation. <br />HISTORY OF VIOLATIONS <br />a.
