FREMONT PAVING and REDI-MIX, INC.
839 MacKenzie Avenue
P. O. Box 841
Canon City, Colorado 81215
Telephone:
(Bus.) 719 - 275-3264
(Res.) 719 - 275-8200
August 13, 2004
Division of Minerals & Geology
Attn: Berhan Keffelew
1313 Shern~an St., Room 215
Denver, CO 80203
RECElVE®
AUG 9 6 2004
Division of Minerals and Geology
RE: Technical Revision/ Partial Release of Reclamation Permit M-1988-093, Florence
South Pit. SWl/4, NWl/4, Section 17, Township 19 South, Range 69 West, 6~' P.M.
Deaz Mr. Keffelew,
Fremont Paving &Redi Mix, Inc. is requesting a paztial release of reclamation, and a
technical revision to extend the mine azea by fifty feet. The Division of Minerals &
Geology conducted an inspection with both the Coal Program and the Minerals Program
on March 2, 2004. The purpose was to investigate a complaint made by Energy Fuels.
At the inspection Fremont Paving &Redi Mix, Inc. was instructed to complete a survey
and determine who the property owner was for the azea located on each side of the
railroad tracks. A second meeting was held at the site on April 12, 2004, to determine if
the property lines overlapped. It was determined at the inspection that boundazies
described in two separate permits had overlapped by fifty feet. More specifically that the
railroad property was fifty feet from the centerline, and Mr. Ary owned the extending
fifty feet near the Florence South Pit. Fremont Paving &Redi Mix, Inc. would like to
include the fifty feet neaz the railroad to the existing permit M-1988-093, and have fifty
feet neaz County Road 79 released from reclamation. This would result in the bond
amount staying the same due to the amount ofacreage continuing to be 22.5 acres.
Please find an attached map showing the azea on the northwest portion of the site to be
added and the portion of the site on the south to be released. Mr. Keffelew has inspected
the site with a representative from Fremont Paving &Redi Mix, Inc., Denise Gonzales,
and advised that the reclamation in the azea for release is acceptable.
Fremont Paving &Redi Mix, Inc. believes that all applicable requirements have been
satisfied according to the rules set forth by the Division of Minerals & Geology to release
the section of the site on the south, which is approximately 50' wide and 425' in length.
We request all rights and succession be returned to Mr. John Ary, landowner.
ASPHALT CONCRETE SAND & GRAVEL
Equal Opportunity Employer
