Peter Mattheis - 2 - April 27, 1990 <br />Rule 2.04.7(3) <br />At a minimum, this section requires a statement of the extent to which the <br />proposed operation may result in damage to established water sources in the <br />permit and surrounding areas. <br />Rule 2.04.9 - Soil Information <br />As discussed in telephone conversations with Mr. Bill Galloway, the soils map <br />(3.5-1) of the disturbed area should be resubmitted at 1:6000 or larger scale. <br />Rule 2.04.10 -Vegetation Information <br />No reference area has been established for comparison with revegetation of the <br />portal areas. NCEC must either establish reference areas acceptable to the <br />Division, or propose alternatives for the evaluation of revegetation success <br />in compliance with the performance standards approved by the Division. If <br />NCEC chooses to establish reference areas, they must be mapped and sampled to <br />demonstrate their similarity to the portal areas. <br />The Vegetation Map (Figure 3.6-1) should be reproduced at 1:6000 or larger <br />scale. <br />Rule 2.04-13 -Annual Reclamation Report <br />Although no submittal is required at this time, NCEC should be aware that a <br />recent rule change requires submittal of this report. The report contents are <br />described in the revised regulations on page 85. <br />Rule 2.05 - Operation and Reclamation Plans - 2.05.3(3) <br />This rule requires descriptions of each existing or proposed surface <br />structure. Lacking here are a detailed description of the slurry-handling <br />structures (location and capacity), a list of buildings with dimensions and <br />construction type (needed far calculation of reclamation costs), and a <br />description of each conveyor and road as required by 2.05.3(3)(c). <br />Another recent Rule change (4.03.2(4)) states that access road drainage <br />systems must be designed to safely pass runoff from the 10-year, 24-hour storm <br />event. The designs should be incorporated in Section 4.2.4.1 of the permit <br />application. <br />A better description is requested of the legal arrangement that NCEC has with <br />the Denver and Rio Grande Railroad for the loading of coal. Rule 1.04.(132) <br />includes the loading of coal under the definition of "Surface Coal Mining <br />Operations", and 2.01.3(1) requires a permit for all such operations. <br />If a pumping station for the hydraulic monitors is to be constructed on the <br />surface (see page 4-15), it must be mapped on Figure 4.2-3 and described in <br />the text. <br />Will sediment cleaned from Pond A be made part of the refuse slurry and <br />disposed of underground? If so, a statement to that effect should be included <br />in Section 4.3.4.1. <br />
