Included was a revised Map 47 <br />delineating the Phase I bond release areas associated with TR-12, <br />which excludes the Pit 1 area, in response to Division Concern <br />No. 1 attached to your letter. <br />Kerr's Phase I bond release application has been pending since <br />April 1994. Kerr consented to an indefinite delay of the <br />Division's bond release decision to address the initial adequacy <br />concerns and because of the controversy regarding the Pit 1 area, <br />which is being resolved by the Settlement Agreement with OSM and <br />our submission of TR-13 on January 31, 199. Tdiiii our submission <br />of the_ additional adequacy responses for TR-12, the DMG should be <br />able to proceed to a decision on the bond release application <br />except for the Pit 1 area. <br />Kerr's reclamation bond renewal date is July 26, 1995. This <br />bond is an annual bond and requires a specific level of collateral <br />as well as the annual fee. For this reason, it is extremely <br />important to Kerr that this bond release decision become final <br />prior to July 26, 1995. We request, therefore, that the DMG issue <br />a prompt decision on partial bond release for all areas as <br />requested, excluding the Pit 1 area as covered by TR-13. <br />Additionally, Kerr requests that the DMG calculate the amount <br />of bond necessary to complete reclamation Phases II and III of the <br />720 and Marr areas and Phases I, II, and III of the Pit 1 area per <br />
