LOng <br />Division Director <br />RE: Sear Mine, File No. C-81-033, Notice of Violation No. C-93-056 <br />Dear Mr. Bear: <br />Tile Division has reviewed the photographs submitted with the <br />Bear Coal Company Minor Revision No. 12 application package on <br />:gyp.-il 1-z, 1993. Subseyaently, pursuant to Rule 4.03.2(6), <br />Notice of Violation (NOV) No. C-93-056 was issued for failure to <br />maintain access roads in such a manner that the approved design <br />standards are met, and that damage to public or private property is <br />controlled or minimized. <br />The Division has not seen the land slide below the Bear Mine fan <br />a;cceot in nhot~graphG~ r.herefore, the timeframes and ahatPmP*+t <br />requirements dictated in NOV C-93-056 are predicated on the assumption <br />that conditions at the Bear Mine No. 3 do not pose imminent danger to <br />the health and safety of the public, and/or the environmental <br />?1~-being of the adjacent land, air and water resources. .f at any <br />time, the conditions referenced at Rule 5.03.211)(a) are found to <br />~.:iat, a cessation order will be issued and the ti.;reframes and <br />abatement requirements for NOV C-93-056 may be revised. <br />If you have any questions, please contact me. <br />Sincerely, <br />.,~~ <br />Steve S.
