page 2

(4) BMG is to use all reasonably practical steps to continue to lower the
cyanide levels in the pond to the lowest reasonably achievable levels,
and to continue to use its best efforts at all times to achieve that
goal. BMG shall attempt to lower the WAD cyanide to a target level of 35
ppm by July 20, 1992. If at any time the staff, or other parties,
believe that BMG is not doing everything resonably practical, 8MG can be
brought back to the Board for further action, including civil penalties
and further corrective action orders.
(5) At the July Board meeting, in addition to reporting genrally on the
status of this problem, the staff shall report to the Board on its belief
as to whether further reductions below the 35 ppm WAD cyanide level can
be achieved, and if so, what further corrective action WAD cyanide level
and schedule ought to be, again recognizing that the ultimate goal is to
bring the cyanide levels into compliance with the permit standards by
October 15, 1992.
