Stenzel °WINNING MOVES" <br />Colorado Water Resources Division <br />1313 Sherman St., Room 818 <br />Denver, Colorado 80203 <br />~ III IIIIIIIIIIIII III <br />RE: Sterling Sand & Gravel Co.; Home Office Mine; Amendment permit application <br />for the Colorado Mined Land Reclamation Division. <br />Dear Dick: <br />Attached is a copy of the above amendment application as submitted to the CMLRD. <br />The amendment combines four existing permitted areas into one composite permit <br />area. The following permits are involved: <br />M-77-439; Pit #1 <br />M-77-440; Pit #2 <br />M-78-256; Reclamation Pit #1 <br />M-86-049; Seaworth Pit. <br />• Under the amendment, areas of planned excavation and estimates of final pond <br />extent have been revised such that the surface area of ponds as presen~ed in <br />the original permits has changed. Our concern is to obtain written assurance <br />from the Colorado Water Resources Division that ponds that did not require <br />augmentation under the original permits does not require augmentation when <br />combined by this amendment. <br />Under Exhibit F - Reclamation Plan Map, the approximate extent of final pond <br />surface area is portrayed. The surface area in acres is detailed for each pond <br />under Table VIII - Pond Surface Acreage and compared with the surface area in <br />acres of the ponds as originally permitted. Ponds created prior to 1973 are <br />not included and are not considered affected land even though they fall within <br />the amended permit area. <br />Table VIII, indicates that the surface area of ponds proposed by the amendment <br />is now less than the total surface area of ponds not requiring augmentation under <br />the original permit. The operator requests acknowledgement that augmentation <br />will not be required for the pond areas presented in this amendment until and <br />unless the final surface area in acres exceeds the total surface area in acres <br />of ponds as represented under the original permits. In such an .event, augmentation <br />would be required and complied with to the extent that the difference between any <br />future excess pond surface area exceeds the surface area of ponds as represented <br />in the original permits. The maps given in the original permit which represent the <br />the pond surface areas are compiled and included here-in for your reference. Since <br />the Seaworth Pit (M-86-049) is under augmentation, it is not to be considered as <br />part of the concern expressed in this letter. <br />.
