Yampa <br />Lamesa, Texas 29331 Craig, Colorado 81625 <br />Re: Cease and Desist Order of the Mined Land Reclamation Board <br />Re: The Joker Mine Property <br />Dear Mc Tuttle and Mr. Zimmerman: <br />On April 24, 2002, the Colorado Mined Land Reclamation Board held a public hearing <br />concerning the Colorado Reclamation Permit for the Joker Mine Property. As a result of that <br />hearing, the Board issued a Cease and Desist Order, which provides in relevant part that no one may <br />conduct anyactivities on that site other than activities which further the reclamation of the property. <br />In otherwords, neitherthepermittee,Mining and Minerals II, Ltd., noranyone else, including <br />both of you and any entities which you represent or control may conduct any mining operations on <br />the property, including sampling and testing. The only activity which may be conducted on the <br />properties are those activities which contribute to or constitute reclamation of the property. Of <br />course, any such reclamation activities must be consistent with the reclamation plan approved by the <br />Mined Land Reclamation Board and the applicable statutes and regulations. Please be advised that <br />Mining and Minerals II, Ltd., is proceeding to make arrangements for the renewal or replacement <br />of the reclamation bond on the property and to commence as soon as practicable reclamation of the <br />property which will involve removal of all of the buildings and improvements on the property <br />subject to the reclamation plan. <br />~~ <br />
