The visits and inquiries have concerned the use and function of the mill located <br /> to the east of Gold Hill. This is apparently a result of contractual disputes that have arisen between <br /> COM, Inc. and Gold Hill Ventures, it is not the County's position or role to intervene in private <br /> disputes but we are often drawn into these issues. <br /> The Zoning division, now relying upon anecdotal information supplied by both parties regarding the <br /> use of the mill and possible violations of zoning, must request that both parties provide full and <br /> factual disclosures regarding the allegations which have been raised. The principal concern at this <br /> time is the admission that ores which have not been produced on the same property have been and <br /> are proposed to be milled at this site. The permit issued for the mill in 1985 clearly states that this <br /> is not a custom mill and is only for the mining conducted on this property. <br /> The ores, which have been produced at the Bueno mine that have been shipped to this site are also <br /> potentially a problem. While it has been the policy of the County in dealing with subsurface mining <br /> to allow a generous interpretation of"affected property", the assembly of a large block of unpatented <br /> claims which create a contiguity of sorts was never the intended result of the definition or the <br /> interpretation. I would, therefore note that all off site ores, i.e. those not produced on the complex <br /> of mines located principally on Bighorn Mountain, shall not be processed at the Gold Hill Mill. <br /> You may provide me with additional clarifying information, however the route to pursue a change <br /> is to file an appeal with the Board of Adjustment. <br /> I am additionally concerned with the disposition of the mill, now in separate ownership.
