"!at:.~~al P.eso_rces
This is to bring you up-to-date on the status of the Summit Pressed Brick
and Tile's Eight Mile Clay Mine's status vis-a-vis the state's Mined Land
Reclamation Board. The Board approved the application on November 23, 1977,
and a letter to that effect from Mr. Drell of the MLR staff is enclosed for
your files. Conditions of approval were stipulated 6y us in writing and
that letter dated December 19, 1977, is also enclosed. Finally, the bond
to the state has been submitted.
In the meantime, a new lease between Summit Pressed Brick and Tile and the
Wingo's has been executed, changing the legal description of the lease area
to allow development to continue around the north end of the pit. It is
necessary, then, to redraw the State's 9.9 acre permit area, a change allow-
able as a "technical revision" according to MLRB Rule 1.9 (memo and exhibits
attached). A corollary to this technical revision is a change in the legal
description indicated on your "Request for Special Use Permit" form, corrected
copy enclosed.
The information provided for you here should be adequate for the issuance of
an up-to-date Special Use Permit by the Fremont County Commissioners. If I
can be of further assistance, please get in touch.
Thank you for your consideration.
Sincerely,
Thomas A.
