j; . <br />,' <br />Page 2 <br />August 26, 1994 <br />Mr. and Mrs. Guffey indicated to the Board their willingness to a/low <br />Abbott/Waison on the property to accomplish the remedial work. Mr. Watson indicated <br />his willingness to do the remedial work. However, we expect the work to be <br />performed according to the guidelines established by the State and that no further <br />damage will be done to the property in the process. In addition, we will expect proof <br />of liability and workers' compensation insurance coverage by Abbott/Watson prior to <br />their commencement of the remedial work. Also, we expect to employ an independent <br />contractor on behalf of the Guffeys to monitor the remedial work. Please notify this <br />office when Mr. Watson would like to gain access to the property to commence the <br />remedial work. <br />Although / am hopeful that Mr. Watson's representations to the Board with <br />respect to completion of the remedial work are sincere, l quite frankly remain skeptical <br />based upon your previous assertions that Abbott has no further responsibility or liability <br />with respect to matters involving the gravel operation. Therefore, l request that you <br />advise me specifically as to the intentions of Abboit/Watson in this regard. <br />Mr. and Mrs. Guffey have no objective other than to accomplish the work <br />mandated by the State in order to prevent the revocation of the permit and to allow <br />its transfer. if Abbott/Watson can accomplish this within the established guidelines, <br />at no cost to the Guffeys, that is certainly acceptable. if that is accomplished by the <br />September deadline, the Guffeys will speak in mitigation of any further civil penalties <br />against Abbott. <br />Although /represent Mr. and Mrs. Guffey, l have tried to relate the current <br />state of affairs as accurately and as fairly as possible. if there is any doubt in your <br />mind as to the accuracy of the facts as l have presented them, l suggest that you <br />contact Mr. Tom Schreiner with the Mined Land Reclamation Division. <br />l believe that the current situation dictates that it is in the best interests of our <br />respective clients to resolve this matter immediately.
