<br /> <br /> <br />-2- <br />CEASE ANO DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2), the Board hereby orders Mine Development, <br />Inc. to: <br />1. Cease and desist adding any cyanide or solution to the system. <br />2. Submit a technical revision prior to conducting further leaching <br />operations at the site. This revision should address repair and <br />reconstruction of the heap leach pit and any plans for construction related to <br />any further leaching. If cyanide leaching activities are not planned then the <br />operator must file for temporary cessation and submit a plan to maintain this <br />site. <br />3. Within 60 (sixty) days, submit a financial warranty for this site to <br />total $7,000.00. <br />4. Pay a civil penalty of $250.00 (Two Hundred Fifty Dollars) within 30 <br />(thirty) days. This penalty was assessed for five (5) days of violation at <br />$50.00 per day. <br />In clarification of the rights of recipients of Notices of Violation, <br />Cease and Desist Orders, parties are advised to consult the Colorado Mined <br />Land Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain <br />acts to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order <br />are advised to consult C.R.S./24-4-106, as amended. pp <br />Dated at Denver this ` day of ~ ~4,~ <br />MINED AND RECLAMATION BOARD <br />Departmery>; oo~f,~Nat~ur/a] Resources <br />B y CC~i~1~ti6~GYf ~` ~~ <br />David C.
