("MPC") Notice of Violation <br />MV-2001-041, Howe Pit, Permit No. M-78-052 <br />Dear Tom: <br />As we discussed by telephone yesterday afternoon, this letter comprises a <br />request for extension of time to submit the Revised Drainage Control Plan <br />specified in Section 2.A of the Mined Land Reclamation Board's Order of October <br />26, 2001. The request is being made on behalf of this firm's client, MPC. The <br />following summarizes the good faith effort MPC has made since the October 17, <br />2001 public hearing in this matter to achieve consensus within the Urban <br />Drainage and Flood Control District ("UDFCD") Task Force on the Revised Plan. <br />The Task Force has met on three occasions since the October 17 public <br />hearing (October 19, October 29, and November 13). I have attached for your <br />review a copy of the latest conceptual drainage plan discussed with the Task <br />Force members at our November 13 meeting. We were scheduled to meet with <br />the Task Force today, but chose to cancel the meeting based on recent <br />developments involving MPC and Ken McIntosh. <br />I understand that John Hickman has had preliminary discussions with Mr. <br />McIntosh regarding the acquisition of an easement over the McIntosh property <br />necessary to convey Bull Seep and storm drainage flows to the South Platte <br />River through the Bull Seep Slough. While MPC believes that the materials it <br />supplied to your office in advance of the October 17 public hearing clearly <br />
