The due date for <br />submitting the bond increase documents is 23 Apri12002. <br />During our discussion at your Denver office on 3 April 2002 you were informed <br />regarding a potential change in ownership of the subject gravel pit. The negotiations in <br />that regazd aze ongoing at this time. <br />At that discussion there were also questions regarding backfilling the previous wash <br />ponds. Those ponds are an integral part of the existing replenishment system for our <br />newly approved wash plant. Also, there was a discussion to not backfill those ponds <br />because they are now a nesting and feeding area for ducks and geese. No decision has <br />been made regarding the final disposition of those wash ponds. Any decision could have <br />a major effect on the bonding requirement for M-1977-170. <br />The area defined by you as "The Creosote Area" is, in fact, that area defined by the EPA <br />as a "Mining Restricted Area" (MRA). No mining or excavation has been undertaken at <br />that area, and none is allowed to be undertaken at that area.
