Long <br />Division Director <br />Rule 5.03.3(2)(b) of the coal regulations requires the Division <br />Director to review the history of violations of any permittee who <br />has been cited for violations as a result of three inspections <br />within the past twelve months, to determine if a pattern of <br />violations exists. The Somerset Mine has been cited with four <br />violations during three separate inspections during the past twelve <br />months.
