The new pond is proposed to have a pernranent pool of 0.9 acre-feet of water. <br />The Division of Water Resources does have a concern with this. The location of the mine is in an azea of <br />the state in which water is over-appropriated and any new consumption of water will result in injury to <br />existing senior water rights. If the water in the pond is being supplied from subsurface sources, it will need <br />to be permitted as a well and if already permitted the permit will have to allow for this increased use. If the <br />source of the water is from surface sources, a well permit is not necessary. However, whether the water is <br />from a surface or subsurface source, any new depletions will need to be replaced by an augmentation plan <br />approved by the Division of Water Resources. <br />I recommend that the operator contact our Division 4 Office in Montrose at (970) 249-6622 for more <br />information on how to proceed. <br />If you have any questions, feel free to contact me at (303) 866-3581. <br />Sincerely, <br />Michael P.
