Reclaimed the lands so they are not contributing suspended solids to streamflow or runoff <br />outside the permit azea in excess of premining levels or in excess of adjacent nonmined <br />areas' <br />Based on the foregoing individual findings, the Division finds that Trapper has met all the <br />requirements for Phase II release of bond from the subject lands. <br />V. PROPOSED DECISION <br />Based on the findings set forth above, the Division proposes to approve Trapper Mining Inc.'s <br />request for a Partial Phase II bond release for the Trapper Mine. This proposed decision will release <br />the applicant from liability for topsoil redistribution and the Phase II requirements for establishment <br />of vegetation for those areas shown on revised Map 1.0 of the bond release submittal. <br />The Division holds a performance bond of $18,500,00.00 for the Trapper Mine. The approval of this <br />Partial Phase II bond release is only a release from the Phase II liability. No bond money will be <br />released and there will be no reduction in the bond amount. The current bond amount will remain <br />intact and is sufficient to assure completion of the remaining reclamation work at the site if the work <br />had to be performed by the Division, including the cost of reestablishing vegetation on any <br />revegetated areas, should those areas fail. The Division estimates its cost to complete remaining <br />reclamation work at the site to be $18,279,608.00. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a forma] public hearing before the Mined Land Reclamation Board in accordance with <br />Section 3.03.2(6). Public notice of this proposed decision will be published twice in the Craig Daily <br />Press for two weeks as soon as possible. Requests for public hearing must be submitted to the <br />Division in writing within thirty days of the first publication in the Craig Daily Press.
