Box 100 ) AND <br />San Luis, CO 81152 ) CEASE AND DESIST ORDER <br />TO: Costilla County and all other persons engaged in or owning or controlling the following <br />operation: Sierra Grande Site. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by <br />C.R.S. 3432.5-123, the Board hereby makes the following findings of fact: <br />Costilla County is conducting a mining operation in the following location: <br />N ~ Section 20, T305, R72W, of the New Mexico P.M., in Costilla County, Colorado. <br />2. On May 29, 1995, the Mined Land Reclamation Board issued Notice of Violation No. <br />M-95-057, which, in part, ordered Costilla County to obtain a permit for this site by <br />October 23, 1995. <br />3. The Mined Land Reclamation Board conducted a Formal Public Hearing on April 24, 1996, <br />to consider possible violation of the above-named Board Order. <br />4. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on <br />April 24, 1996, demonstrating that Costilla County has not obtained a permit for this site. <br />NOTICE OF VIOLATION <br />Based upon foregoing Findings of Fad, the Mined Land Reclamation Board hereby finds <br />Costilla County to be in violation of Notice of Violation M-95-057, issued pursuant to <br />C.R.S. 3432.5-124(2). <br />CEASE AND DESIST ORDER <br />Based upon the same Findings of Fad and Notice of Violation, and pursuant to the provisions of <br />C.R.S. 34-32.5-123, the Board hereby orders Costilla County to: <br />1. Continue to cease and desist all mining operations. <br />O <br />
