<br />SNOWCAP COAL COMPANY <br />NOTICE OF VIOLATION <br />ENGINEER'S CERTIFICATION <br />Notice of Violation CV-2006-002 was written for failure to constructor maintain permanent <br />drainage structures associated with coal waste disposal areas to; (1) prevent drainage <br />over the outslope of the fill (CRDA-1 ); (2) safely pass runoff from a 100 year, 24 hour <br />precipitation event (RSRDA) and; (3) ensure diversion stability (RSRDA). <br />Abatement steps were to; (1) restore RSRDA upper diversion segment "B" to design <br />specification by August 13, 2006; (2) clear sediment and debris from inlet of DOT culvert <br />near pond 9 outlet by August 18, 2006; (3) restore CRDA-1 terrace ditch #4 to design <br />specification by August 23, 2006; and (4) submit a P.E. certification documenting proper <br />repair of RSRDA Upper Diversion and CRDA-1 terrace drain #4 by October 1, 2006. <br />Repair to the RSRDA upper division segment "B" was performed during late July and early <br />August. Portions of the ditch rip rap plating were grouted to improve stability. The design <br />for segment "B" is located in Appendix 14-6; page 14-6-1. <br />Repair to the CRDA-1 terrace ditch #4 was performed during mid to late August. The <br />design of the terrace ditches is located in Table 13-4; page T13-4-3. <br />I, James E. Stover, have inspected the repair of RSRDA upper diversion segment "B" and <br />the repair of CRDA-1 terrace ditch #4. To the best of my knowledge and belief the repairs <br />meet the applicable performance standards and the design criteria presented in <br />Snowcap's Mining and I~e~4~` Permit, C-81-041. <br />Date <br />' Abafement date extended from August t8"' to August 23rtl. <br />
