.. - ~~. <br />BILL OF SALE <br />KNOW ALL PERSONS that LUCY GLORIA DAMS ('Seller'), for and in <br />consideration of $10.00 and other good and valuable consideration <br />from Landmark Reclamation, Inc. ('Buyer'), the receipt and <br />sufficiency of which are hereby acknowledged, has bargained, sold, <br />granted, transferred, conveyed and assigned to Buyer, its <br />successors and assigns, the following property owned by Seller: <br />A coal crusher (Eagle model CLP-100H, VIN <br />10150) (the 'Crusher'). <br />THE CRUSHER SHALL BE CONVEYED TO BUYER 'AS IS,' 'WHERE IS' AND <br />'WITH ALL FAULTS,' WITHOUT ANY REPRESENTATION OR WARRANTY OF <br />MERCHANTABILITY. FITNESS FOR ANY PARTICULAR PURPOSE. AS TO ITS <br />CONDITION, OR ANY OTHER WARRANTY. EXPRESS OR IMPLIED. SELLER <br />SPECIFICALLY DISCLAIMS ANY WARRANTY. GUARANTY OR REPRESENTATION, <br />ORAL OR WRITTEN. PAST OR PRESENT. EXPRESS OR 1ZIPLIED. CONCERNING <br />THE CRUSHER. BUYER ACKNOWLEDGES THAT BIIYEFt IS NOT PURCHASIN(' THE <br />CRUSHER IN RELIANCE ON ANY INFORMATION OR REPRESENTATION PROVIDED <br />BY SELLER, OR ANY AGENT OF SELLER.
