Long <br />D ivicion Urrectnr <br />The Division has received Mountain Coal Company's (MCC) request for <br />an extension for the abatement of Notice of Violations (NOV) C-93- <br />112, 113, and 114. The Division has determined that NOV C-93-113 <br />can be vacated. This information is forthcoming. The regulations <br />only allow for a maximum of 90 days from the date of issue of the <br />NOV, within which abatement should be accomplished. .To extend the <br />abatement period beyond 90 days requires specific circumstances and <br />conditions which do not apply to MCC or these violations <br />(5.03.2(2)(c)). Therefore, the Division will extend the abatement <br />deadline to November 11, 1993. Both NOVs were issued on Auqust 12, <br />1993. <br />Enclosed you will find a form entitled, "Extension of Time for <br />Abatement Notice" for NOV C-93-112 and 114.
