•~ <br /> <br />sornc i 991 e~e~ 495 <br />the Colorado Revised Statutes, 1973, 37-92-602., 1.(b),(c) and <br />3.,(b),(II), which provides, among other things, the use of up <br />to 15 gallons per minute for. domestic purposes, the irrigation <br />of up to one acre of home gardens and lawns, and the watering <br />of domestic animals and livestock. -Permitted uses of private, <br />indivitfual wells is further regulated by the State of Colorado. <br />Such use is not further restricted herein except that a <br />property owner shall be in violation of these Restrictions if <br />irrigation water is permitted to flood andJor erode neighboring <br />property. <br />~. Electronic Equipment: Television receiving antennae are <br />{permitted. No equipment-generated electromagnetic energy <br />which ,may interfere with communic~ tiom reception shall be <br />permitted unless equipped with an adequate suppressor.. <br />K. Lighting: Any exterior lighting erected on any parcel shall <br />be shaded so as not to create a nuisance to the owners of <br />adjacent parcels. <br />4. Fences <br />A. •It is the responsibility of each owner to confine his livestock <br />within the boundaries of his parcel with fences constructed to <br />at least the minimal standards for a "lawful fence" as described <br />ARTICLE 46, paragragh 35-46-101. Definitions, of Colorado <br />Revised Statutes, 1973. <br />B. Perimeter parcel fencing shall be placed at the utility <br />easement line where such lines occur, and in such a manner so <br />as not 'to obstruct access to that easement: The intent of <br />this Restriction is to provide unimpared access to that <br />easement not only for the various utility companies, but to <br />provide access to and use of the easement for horseback riding, <br />hiking or other recreational activities not incbnsistent with <br />the Conditions, Covenants and Restrictions contained herein. <br />5. Maintenance of Parcels: It shall be the responsibility of the <br />owners to keep their parcel neat and clean, lawn mowed, or landscaped <br />in reasonable condition and compatible with surrounding parcels, <br />and the improvements on their parcels in a state of repair in such <br />a way as to not destroy or impair the aesthetic qualities of the <br />area. <br />6. Remedies for Violation: In the event of any violation or threatened <br />violation of any of the restrictions herein, Other Owners may bring <br />action at law or in equity, either for injunction, action for <br />damages or such other remedy as maybe available. In the event the <br />Other Owners recover judgment against any person for a violation or <br />threatened violation of any of tfie covenants fierein, the Other <br />Owners or owner shall also be entitled to recover fi rom such person <br />reasonable attorneys' fees. <br />
