Cattany <br />Division Director <br />Natural Resource Trus[ee <br />We have completed a review of the pemut application for the New Elk mine regazding Permit Renewal <br />No. 4 (RN-04). The application was received on August 29, 2003. Due to the lack of evidence that a <br />liability insurance policy was in force and the absence of a copy of the required public notice, your <br />application was found incomplete on September 4, 2003. Following abatement of NOV CV-2003-010 <br />on October 10, 2003, issued for failure to maintain a public liability insurance policy in force, and <br />receipt of a proposed public notice, the application was found complete on November 14, 2003. <br />The permit application was reviewed with emphasis on those azeas of the operation and reclamation <br />plan that aze most likely to be of significance during the next five-yeaz permit term. <br />Please respond to the following questions or comments as soon as possible. <br />Please update Section 2.03 of the permit application, including Exhibit 1, if necessary and Map <br />1, Surface Ownership. Specific problems noted include: <br />no City, State, or zip code for Harteis <br />Pinston or Pinkston? Both are used on Map and in text <br />Please confirm and correct all information in Section 2.03 with current information <br />2. Please update the Operation Description on page 2.05-5 based on status at Lorencito and the <br />removal of the raikoad.
