Box 783 Trinidad, Colorado 81082 Re: Division Proposed Decision on TBM Ludlow Loadout Technical Revision to Permit No. C-048-81 Dear Mr. Mills: The Division has issued a proposed decision to approve, with the following stipulations, the technical revision to construct and operate a coal rail Loadout facility at Ludlow, Colorado. The following stipulations will become a binding part of the Trinidad Basin Mine coal mining and reclamation permit No. C-048-81. TBM is responsible for the satisfaction to these stipulations within the stated timeframes. STIPULATION N0. 1: AS APPROVAL IS GRANTED FOR A NPDES PERMIT, AND AIR EMISSIONS PERMIT, THE PERMITTEE SHALL FORWARD COPIES OF EACH TO THE DIVISION FOR INCORPORA- TION INTO THE MINING AND RECLAMATION PERMIT N0. C-048-81. STIPULATION N0. 2: LOADOUT CONSTRUCTION MAY tlOT BEGIN UNTIL SUCH TIME AS THE STATE HISTORIC PRESERVATION OFFICE DETERMINES THAT MITIGATION IS NOT REQUIRED TO PROTECT THE LUDLOW MEMORIAL, OR THE PERMITTEE AND THE DIVISION AGREE TO SUCH MITIGATION MEASURES WHICH MAY BE REQUIRED. STIPULATION N0. 3: PRIOR TO INITIATION OF LOADOUT CONSTRUCTION, THE PERMITTEE MUST POST ACCEPTABLE SURETY WITH THE DIVISION FOR THE SUM OF $3,700.00. STIPULATION N0. 4: WITHIN 30 DAYS OF COMPLETION OF SEDIMENT POND S-1, THE PERMITTEE SHALL PROVIDE CERTIFICATION THAT THE STRUCTURE HAS BEEN CONSTRUCTED AS DESIGNED.
