("OMI") has completed some regrading and has constructed water bars along the emergency drill roads completed earlier this year in "A"Gulch and "C" Gulch. Also, the entrances to these roads have been blocked. Although OMI is not currently utilizing the roads to access the holes drilled for mine fire gas monitoring or for pumping water, it is possible that one or more of these holes may yet be needed for future mine atmosphere or other monitoring or remediation. As such, OMI does not believe that it is prudent to complete reclamation of the drill holes and roads at this time. OMI had, in fact, said in its April 7, 1999 application for NOI 99-223-02, that reclamation would not be completed until June 30, 2000. Nonetheless, OMI agrees that some seeding and maintenance of the water bars would better prepare these roads and drill sites for winter weather and spring runoff. OMI intends to complete this work before the end of October 1999. By May of next year, OMI believes that future uses (if any) of these roads and drill holes can be determined.
