The purpose of this letter is two-fold. The firs[ purpose is to <br />clarify [he status of abatements. The second purpose is [o establish appropriate dates of revision decisions <br />to implement the abatements in the Permit Application Package. <br />Twentymile Coal Company (Twentymile) submitted MR 5-194 to abate, in part, the notice of violation. As <br />you may recall, the revision was submitted as MR 5-194, but it was entered into Division of Minerals and <br />Geology (Division) management control as MR-193 (the next sequential number, based upon date of <br />receipt). However, the Division subsequently agreed to consider the application under your control number <br />(MR-194). The MR-193 designation has been reserved for a future submission. <br />Although the application (MR-194) included the tteeessary changes to the Permit Application Package <br />(PAP) to abate Parts 2, 3 and 4 of CV-2005-006, deficiencies were found in repagination of the PAP to <br />incorporate the proposed minor revision. Thus the Division of Minerals and Geology (Division) was not <br />able to approve the application. Thus to date, Parts 2, 3 and 4 remain unabated. <br />In order to allow Twentymile time to repaginate the proposed minor revision, the abatement time was <br />extended to 30 June 2005 for Part 2 (date of issue 13 June 2005) and for Parts 3 and 4 (date of issue IS <br />June 2005). <br />At this time, the due date for a decision on MR-194 is June 23, 2005. As [he Division has not received from <br />Twentymile the necessary revised pages, please request a waiver of the due date for a decision on MR- <br />194.
