One issue discussed at this <br />meeting regarded the current status of certain potentially unstable slope areas identified at <br />the Grassy Gap Mine site by ACZ, Inc. ("ACZ") in a report dated October 23, 1985 (the <br />"ACZ Report"). The ACZ Report identified, and recommended stabilization measures for, <br />eleven unstable slope segments.l The recommenced stabilization measures varied from <br />minor regrading to installation of toe buttresses. <br />During the summer of 1990, Rockcastle reevaluated the stability of the potentially <br />unstable slope adjacent to the Pit 4 haul road2 pursuant to $ N.2 of the June 26, 1990 <br />agreement between CMLRD and Rockcastle (the "CMLRD Agreement"). Based upon the <br />results of this reevaluation, Rockcastle proposed to install a toe drain and small cover <br />buttress to assure the stability of Segment No. 3. CMLRD approved the reclamation <br />measures proposed for Segment No. 3 on November 2, 1990. Rockcastle completed these <br />reclamation measures on November 20 and 21, 1990. <br />1 The eleven potentially unstable slope segments are identified as Segment Nos. 1, 2, <br />3, 4, 5, 6, 8, 9, 10, 11 and 12 in the ACZ Report. <br />2 This potentially unstable slope is identified as Segment No. 3 in the ACZ Report. <br />
