<br />permit revision was approved in September of 1985. The additional <br />bond coverage was stipulated to be submitted to the Division "no <br />later than 60 days prior to initiating of any disturbance associated <br />with the permit revision approval." As of the date of permit <br />renewal, construction of the Central Facilities Areas has not yet <br />begun. Therefore, Stipulation No. 17 will remain attached to the <br />permit for the second permit term with the actual bond amount <br />adjusted to reflect current reclamation costs as indicated below. <br />During the permit renewal review process, the bond amounts for both <br />the original permit and the Central Facilities Area permit revision <br />were reviewed by the Division to determine whether the previously <br />calculated amounts needed to be updated. As a result of the review, <br />the Division found that the bond amount for the original permit <br />needed to be increased from $307,630.00 to $322,700.00, and the bond <br />amount for the Central Facilities Area permit revision needed to be <br />increased from $691,304.00 to $1,046,000.00. <br />Pursuant to Rules 2.07.6(2)(j) and 3.02.1(1), performance bonds in <br />this amount will be filed with Y.he Division, payable to the State of <br />Colorado and the United States Government/Office of Surface Mining. <br />The following stipulations are required by the Division: <br />STIPULATION N0. 17: <br />A PERFORMANCE BOND IN THE AMOUNT OF $1,046,000.00, PAYABLE TO THE <br />STATE OF COLORADO LAND THE UNITED STATES GOVERNMENT/OFFICE OF SURFACE <br />MINING, MUST BE FILED WITH THE DIVISION NO LATER THAN 60 DAYS PRIOR <br />TO INITIATING ANY DISTURBANCE ASSOCIATED WITH THE PERMIT REVISION <br />APPROVAL. NO DISTURBANCE SHALL OCCUR UNTIL THE PERFORMANCE BOND HAS <br />BEEN APPROVED AND ACCEPTED BY THE DIVISION. <br />STIPULATION N0. 18: <br />A REPLACEMENT PERFORMANCE BOND IN THE AMOUNT OF $322,700.00 OR A BOND <br />RIDER INCREASING BOND COVERAGE FROM $307,630.00 TO $322,700.00, MUST <br />BE FILED WITH THE DIVISION AT LEAST 30 DAYS PRIOR TO THE PERMIT <br />RENEWAL DATE OF JANUARY 12, 1988. THE REPLACEMENT BOND OR BOND RIDER <br />MUST BE MADE PAYABLE TO THE STATE OF COLORADO AND THE UNITED STATES <br />GOVERNMENT/OFFICE OF SURFACE IAINING. <br />With the acceptance by the applicant of the above stipulations, the <br />operation is in compliance with the requirements of this section. <br />Based on a preponderance of the evidence, the permit issued to Salt Creek <br />Mining Co. meets the requirements under the right of successive renewal. <br />The permit application will remain a binding part of the permit. Renewal of <br />the permit will be fora term of five (5) years. <br />
