Shelton <br />Director <br />Re: Swartzwalder Mine - File No. 77-300 Notice of Board Consideration of <br />Possible Violations. <br />Dear Mr. Smith: <br />It has been determined that the following provisions of the permit may have <br />been violated: the provisions concerning (a) The temporary waste pile; <br />(b) uranium content; and (c) operation of a gravel (borrow) pit. The follow- <br />ing facts-constitute the violation: <br />A. The temporary waste pile is larger that the 1.14 acres outlined in the <br />permit. <br />B. The temporary waste pile is in the wrong location as outlined in the permit <br />and is spilling into Ralston Creek. <br />C. The cutoff for the uranium content of rock to be placed in the waste pile <br />is .07 percent tatl~er than the .015 percent which is permitted, <br />D. A '~ acre unpermitted gravel pit was opened adjacent to Ralston Creek with <br />no topsoil salvage. <br />The Mined Land Reclamation Board will consider the possible violations at the <br />Board's November 17-18, 1982, meeting to take place in Room 110 of 1313 Sherman <br />Street, Denver, Colorado, commencing at 9:00 A.M. each day. Your matter will be <br />heard as soon after commencement as possible.
