DRAFT RF.VEGETATION RULES 10/OS/01 <br />NOTE: DMG has rewritten this rule after internal discussions and <br />discussions with the OSM. <br />12. Amend Rule 4.15.8(8) as follows: <br />[A,B-2] <br />(8) Where the approved post-mining land use is forestry, ~~~~~~~_~~~' °°-°°' the <br />revegetated area will be stocked using documented local and regional refo:resta[ion <br />practices of appropriate State or Federal agencies for the species to be planted in the <br />commercial forest, with the exception that where no such practices exist, the minimum <br />acceptable stocking rate shall be 450 Ireesbs per acre. The stocking rate and <br />planting arrangement for commercial tree species shall be approved by the State <br />Forester. Establishment of the trees-slobs shall be considered acceptable if the <br />density is not less than 90% of the standard. Stocking rates shall be determined on the <br />basis of countable trees ~-' °"~•"° °° a°F°°a ~~ ^.' ~.°~" which can be used in the <br />calculation of density under the following criteria: <br /> <br />(a) The tree shall be of a species deemed appropriate for the forestry post-mine <br />land use by the Division; <br />(b) The tree shall be alive and healthy and shall have been in place at !cast two <br />growing seasons; and <br />(c) At the time of final bond release, at least 80 percent of the trees used to <br />determine such success shall have been in place for at least 60 percennt of the <br />minimum period of liability, as described in 3.02.3. <br />13. Amend Rule 4.15.9 as follows: <br />~] <br />4.15.9 Revegetation Success Criteria: Cropland. <br />For areas to be used as cropland, success of revegetation shall be determined on the basis of <br />crop production from the mined area as compared to approved reference areas or other <br />approved standard(s). Crop production from the mined area shall no[ be less than [hat of the <br />approved reference area or standard for tkeaast two years of the exter~ed liability period <br />established in 3.02.3. Crop production shall not be considered prior to year 9 of the <br />liability period. With respect to annual grain crops for which the cropping cycle may <br />incorporate a summer fallow year, two of the last four cropping years will be considered. <br />This liability period shall commence on the date of initial planting of the crop being grown. <br />
