Annual <br />reports have been submitted variously by the Permittee, the Lessee, or some combination. The <br />industriaUcommeroial post-mining land use for the site calls for relatively little reclamation, except <br />on benches left by the operation. <br />A site inspection conducted November 21, 2002 at the request of the contractor, Elk Creek Sand <br />and Gravel, discussed possible revisions to the mining plan. The contractor at that time was the <br />Inspection and Enforcement Contact. <br />Based on the site inspection of October 17, 2005, the Division of Minerals and Geology (Division) <br />requested that the Operator post permit boundaries, identify structures and operations within the <br />permit boundary that were not shown in the permit documents, submit a revision to the permit to <br />account for a revised mining plan, and revise the reclamation bond. <br />After studying that report, representatives of Aspen Enterprises, the Permittee, met with Division <br />staff on February 2, 2006 to report that mining had been conducted outside the permit boundary. <br />Total disturbance outside the permit boundary was reported be 2.47 acres. Approximately 0.5 acres <br />of the disturbance involved operations conducted by the landowner.
