Banta. <br />Division Director <br />The Division is writing NOVs to Rock castle in response to TDNs 91-2-116-4 TV 2 <br />and TY 3, and in accordance with paragraph VIII (5) of the Rock castle and <br />Colorado Mined Land Reclamation Division Agreement dated June 26, 1990. <br />The abatement requires compliance with the monitoring and inspection <br />commitments as identified in the regulations and in the permit. The pond <br />inspection requirement has changed to a quarterly requirement; see the <br />attached Rule 4.05.6(13). Consequently, the 1989 MR-7 to modify the pond <br />inspection frequency to a semi-annual requirement is no longer in force. <br />have also enclosed a copy of the current water monitoring plan. <br />Rock castle has fifteen days from receipt of the violations to submit <br />information identifying exceptional circumstances associated with the alleged <br />violations. Upon receipt of a proposed civil penalty, Rock castle has another <br />ten days to request an assessment conference. The Division will fix the <br />penalty, if no request for an assessment conference is received. Please <br />review Rules 5.03 and 5.04 for additional clarification on the violation and <br />civil penalty procedures. <br />
