<br />accomplished during the 1994 season. Page 2.05-39 was revised to <br />incorporate the postmining land use of undeveloped/ gublic use at <br />both areas. At the same time map ES-3300 was revised to update <br />and label those areas that were designated undeveloped/public use. <br />On September 29, 1994 OSM issued the TDN to DMG. <br />In response to this action, DMG requested that Sanborn Creek submit <br />a revision to their permit which would fully comply with all <br />aspects of the various AOC rules. Technical Revision-23 was <br />submitted on November 10, 1995 and after a lengthy review process <br />the revision was approved on July 26, 1995. During the review it <br />was revealed that it was very difficult to comply with all the <br />requirements for obtaining a variance from AOC and in the end the <br />operator committed to utilizing more of the down spoiled material <br />for backfill even though it compromised the overall safety factor <br />for stability. <br />Changes to the plan that resulted from approval of TR-23 are <br />detailed in pages 2.04-5, 2.05-33, 2.05-33i, 2.06-5, 6 and 7, <br />2.06-10; Appendix B, pages 168-173 and Appendix J, pages 1-4; <br />Revised map 8 and drawings C8-1226R, C8-787AR, and C8-1232. <br />During the public comment process the Division did receive an <br />objection to the approval of TR-23 from Bear Coal Company and a <br />request to appear before the Board to discuss the approved plan. <br />The objection concerned the amount of backfill that would occur <br />because Bear is apparently exploring mining opportunities in Bear <br />Canyon and had been reviewing the Sanborn portal bench as a <br />possible location for future facilities. To date this objection <br />has not been resolved. The Board appearance has been extended <br />until March, 1996 to allow Bear additional time to investigate <br />mining opportunities in Bear Canyon including how Sanborn Creek's <br />portal bench might fit into those plans. <br />As a result of this objection the Bear Canyon facilities were not <br />reclaimed in 1995 so MR-32 was submitted on September 8, 1995 to <br />once again resequence the reclamation timetable. The changes are <br />detailed in section 2.05-32. <br />Even though the operator has not been able to complete the <br />reclamation at either Bear Canyon or Hubbard Creek, they have <br />completed a significant amount of preliminary reclamation including <br />removal of most of the concrete footers and foundations. This <br />material has been placed against the cut-slope and covered up. The <br />portals at both locations have been at least partially backfilled <br />and at Hubbard Creek the current configuration will likely be the <br />final contour. In addition, stream channel repair work was <br />conducted at Bear Canyon in conjunction with repair work on a small <br />slide that occurred at the base of the portal bench fill. This <br />activity was conducted under MR-33 which was submitted on October <br />10, 1995 and is detailed on page 2.05-33. <br />This is a brief synopsis of the actions that have occurred <br />
