MCC completed structural inspections and visual and survey monitoring of the Mautzes' cabin
and vicinity, both before and after mining in the area was completed. A certified appraisal and
professional builder assessments of the cabin were also completed and indicated that most of the
defects in the cabin were due to poor quality construction andJor the lack of appropriate design.
Nonetheless, MCC completed repairs to the cabin on more than one occasion, and provided
compensation to the Mr. and Mrs. Mautz in excess of the diminished value of the cabin (estimated
by the certified appraiser) prior to the repairs. MCC has not heard any concerns about the cabin
from Mr. and Mrs. Mautz since that compensation payment was accepted by them.
MCC reiterates that Jumbo Mountain, including the areas of the Mautzes' concern, have been
assessed by experts as past, current, and future landslide areas. However, MCC remains ready to
complete repairs to the roads that may have been damaged by subsidence and is willing to
complete (and has completed) other minor road maintenance, as well. Similarly, fences or any
other structures that maybe or may have been damaged by subsidence will be repaired, replaced
or compensation provided in accordance with the regulations.
Please contact me should you have questions or require further information.
Sincerely,
~~~~~ ~~~
Kathleen G.
