Sun <br />Coal received this NOV on May 31, 1994 and the next day, met with Mr. Eugene <br />Shearer, P.E. on-site to evaluate and discuss potential solutions to the alleged non- <br />compliance. While Mr. Shearer is diligently working to prepare a response and <br />designs to address the Division's concerns, it may not be feasible for Sun Coal to <br />prepare and submit the required technical revision (TR) by June 13, 1994. Sun <br />Coal believes that the requirement for submittal of the TR within thirteen <br />calendar days of receipt of the NOV is arbitrary, given the Division's past policy <br />_ of allowing between thirty and ninety days for submittal of revisions (especially <br />those requiring engineering designj. N'or these reasons, Sun Coal requests ari <br />extension of the time for submittal of required technical revision to July 30, 1994 <br />with corresponding extensions for remedial action steps 2 and 3. <br />If you have any questions, please feel free to contact me or Michael Savage. <br />Sincerely, <br />Bryan J.
