M-88-112 Division Director <br />Dear Ms. Hayes: <br />I reviewed your letter dated October 20, 1995, which outlined your understanding <br />of the sampling and reporting requirements for poet-detox samples. <br />You are correct in your interpretation of TR-006 requirements for post-detox <br />samples. <br />You are partially correct in your interpretation.of TR-010. An INCO tailings <br />sample (which you refer to as poet-detox) will be collected once eve~Y 5 to 9 days <br />and analyzed at your on-site lab. The analyses are to be-reported oM'ice a month. <br />In each report a 30-day average is calculated for the INCO tailings sal~lple. In the <br />event that any weekly 30-day rolling average determination is found tb exceed 3.8 <br />ppm WAD and/or 4.4 ppm total cyanide, then BMRI must initiate certain intermediate <br />response actions. One of these response actions includes the sampling of the <br />tailings pond. The intermediate response actions were outlined in my ]letter to you <br />dated August 4, 1995. <br />The Division agrees that the post-detox/INCO tailings sampling station is not a <br />compliance point and the Division will not pursue a possible violation enforcement <br />action if the samples from that station exceed the permit standards. <br />The post-detox/INCO tailings samples are used for early detection of possible <br />problems in the tailings facility which is a compliance point. <br />If you are still confused, please give me a call.
