BANTA, Director
December 9, 1987
Mr. Peter Matthies
New Castle Coal Company
9137 East Mineral Circle
Englewood, Colorado 80112
Re: C-84-065; Determination of No. Patterns of Violations for C-87-013 and
C-87-047
Dear Mr. Matthies:
Enclosed is a memo to the Coal Ridge file stating why the above referenced
NOVs do not constitute a pattern of violations. Under Rule 5.03.3 the
Division mdy determine that violations issued on two or more inspections
during a 12~nonth period constitute a pattern of violations. If such a
determination were made, the Director of the Division would then be required
to determine whether to issue an order to show cause why the permit should not
be suspended or revolved. As preciously stated no pattern of violations was
determined for these two NOVs so no Show Cause Order will be issued. I would
recommend, however, that you familiarize yourself with Rule 5.03.3 of our
regulations. Please call if you would like to discuss this procedure with me.
Sincerely,
Candace M.
