A. D. 1984, by and bet~,•een Otis Lyons hereinafter referred
to as "GRANTOR", and THE BOARD OF COUNTY COI.1F11SSIOtJERS of the COUi1TY OF t10FFAT,
STATE OF COLORADO, hereinafter referred to as "GRANTEE",
W I T N E S S E T H:
1. That the Grantor, o~aner of mineral rights in certain lands in the
County of i•loffat, State of Colorado, grants and warrants to Grantee the right
to remove and sell sand and gravel, and the right.of entrance with truck and
crusher plant upon the said lands in the County of Moffat, State of Colorado,
described as follows, to-wit:

2. That the terms of this Agreement shall extend for a period of 5
}•ears from the date hereof, with the option on the part of the Grantee to renew
this Agreement for an additional period of 5 years.
3. That the Grantee agrees to pay Grantor the sum of $750.00
Seven hundred fifty perYear which will entitle the Grantee to remove
2,145 cubic yards of sand and gravel. The Grantee shall
have the right to remove additional quantities of sand and gravel for ~•ihich
Grantee will pay GrantorThirty-fivecents ( •35 t) per cubic yard for the
additional sand and gravel removed. Payment is to be made on quantities as
measured by a reputable engineer of Grantee.
Grantee shall, at all times, keep written records of the amounts of
material removed from said land and the same shall be available to Grantor
for the purpose of verifying such amounts.
In the event Grantee desires to renew this Agreement the price per
cubic yard shall be negotiated bet~•:een parties hereto, and in the event
said price cannot be agreed upon, then the option to renew this Agreement shall
be null and void.
Grantor reserves the right to sell pit run gravel to private parties.
